The
following are the rules or "Terms" that govern use of the What's on Sydney website
("Site"). By using or visiting the Site, you expressly agree to be
bound by these Terms and to follow these Terms and all applicable laws and
regulations governing the Site. What's
on Downunder and whatsonsydney.com (collectively "What's on
Downunder") reserve the right to change these Terms at any time, effective
immediately upon posting on the Site. Please check this page of the Site
periodically. If you violate these Terms, What's
on Downunder may terminate your use of the Site, bar you from future use
of the Site, cancel your ticket order, and/or take appropriate legal action
against you.
Permitted
Use
General Users
You agree
that you are only authorised to visit, view and to retain a copy of pages of
this Site for your own personal use, and that you shall not duplicate,
download, publish, modify, delete or otherwise distribute the material from
this Site for any purpose other than for personal use, or to purchase tickets
or merchandise for your personal use.
Industry Users
Organisations/
venues / events organizers are permitted to add and update events to the Site,
which will be subject to review before being uploaded and must follow the
Entertainment Industry Code of Fair Practice. These events/ attractions will
only be accepted if they are open to the general public. What's on Downunder reserves all rights
when deciding whether the event/ attraction is appropriate for the Site.
Ticket
Purchase & Refund Policy
Terms
- The right of admission is reserved by the relevant
venue.
- All tickets holders that have purchased on line at a
discount price, such as student, pensioner concession, club membership discount
etc, may be asked to show the relevant ID at the venue.
- The venue may reserve the right to vary advertised
artists and programs.
- The venue reserves the right not be admit latecomers
until there is a convenient break in the program.
- The venue reserves the right not to permit cameras,
audio and video recorders.
Purchased tickets/gift vouchers will be emailed to you as an eticket as soon as payment is confirmed or will be available for collection at the venue's box office on the day of the event
All payment transactions will be in Australian dollars
All payments are made using a SSL 128 bit secured connection
We accept Visa and Mastercard online payments only
Refund
What's on Downunder sells
tickets and gift certificates on behalf of various clients, who in turn set the
prices and determine seating locations. Policies set forth by our clients, such
as venues and theatres; prohibit us from issuing exchanges or refunds after a
purchase has been made or for lost, stolen, damaged or destroyed tickets. When
you receive your tickets, please keep them in a safe place. Please note, once
you have purchased tickets you are solely responsible for them.
Occasionally,
events are cancelled or postponed by the promoter, team, performer or venue for
a variety of reasons. If the event is cancelled, please contact us for
information on receiving a refund from the responsible party. If the event was
moved or rescheduled, the venue or promoter may set refund limitations. The
refund can only be made to the Credit Card used to make the booking. The
booking fee is not refundable. To ensure your best chance of obtaining a
refund, please contact What's on
Downunder within 24 hours. If a refund is requested and What's on Downunder is not at fault,
then an additional processing fee equivalent to the original transaction fee
will apply.

We
reserve the right to block access to or cancel a ticket order on any user known
or reasonably believed to be associated with any ticket broker or scalper, or
utilizing automated means to process or place ticket orders, or whose ticket
order exceeds the stated limit.
Transaction
Pricing Policy
What's on Downunder will charge a small booking fee for each ticket purchased. The transaction charges are variable depending on the value of the individual tickets.
Third
Party Sites
The Site may link to third party sites throughout the World Wide Web. What's on Downunder has no control over
these sites or the content within them. What's
on Downunder cannot guarantee, represent or warrant that the content
contained in the sites is accurate, legal and/or inoffensive. What's on Downunder does not endorse
the content of any third party site, nor do we warrant that they will not
contain viruses or otherwise impact your computer. By using the Site to link to
another site, you agree and understand that you may not make any claim against What's on Downunder for any damages or
losses, whatsoever, resulting from your use of the Site to link to another
site. If you have a problem with a link from the Site, please notify us - info@whatsonsydney.com and we will
investigate your claim and take any actions we deem appropriate.
Competitions
From time to time What's on Downunder will run competitions to giveaway tickets to events in the form of a free draw. These draws are open to the general public but the entrant must be over the age of 18 and may only enter each draw once.
No staff or family member associated with What's on Downunder are eligible to enter. All winners will be notified via email and announced either in the weekly newsletter or through Twitter and Facebook. Generally, ticket prizes are non-transferable or exchangeable for a different date.
We adhere to the rules and regulations set out by the Office of Liquor, Gaming & Racing. Our NSW permit number: LTPM/10/00074 Class: Type B.
Content
The content on the Site follows the Entertainment Industry code of Fair Practice.
All content on the Site is monitored.
Following
is a list of the kind of content which is prohibited on the site. It includes content
that:
- is patently offensive to the online community,
such as content that promotes racism, bigotry , hatred or physical harm of
any kind against any group or individual;
- could be harmful to minors;
- harasses or advocates harassment of another
person;
- involves the transmission of "junk
mail", "chain letters", or unsolicited mass mailing or
"spamming";
- promotes information that you know is false,
misleading or promotes illegal activities or conduct that is abusive,
threatening, obscene, defamatory or libellous;
- promotes an illegal or unauthorized copy of
another person's copyrighted work, or providing pirated music or links to
pirated music files;
- displays pornographic material of any kind;
- provides material that exploits people under the
age of 18 in a sexual or violent manner, or solicits personal information
from anyone under 18.
Violation
of the Terms
You understand and agree that What's on
Downunder has sole discretion, and without prior notice, may terminate your access to the Site, cancel
your ticket order or exercise any other remedy available and remove any
unauthorized user content, if What's on Downunder believes that the
User Content you provided has violated or is inconsistent with these Terms of
Use, another User or the law. You agree that monetary damages may not provide a
sufficient remedy to What's on Downunder
for violations of these terms and conditions and you consent to injunctive or
other equitable relief for such violations. What's
on Downunder may release user information about you if required by law
or subpoena, or if the information is necessary or appropriate to release to
address an unlawful or harmful activity. What's
on Downunder is not required to provide any refund to you if you are
terminated as a User because you have violated these Terms of Use. For more

The content and software on this Site is the property of What's on Downunder and is protected by
Australian and international copyright laws. We post a legal notice and various
credits on pages of the Site, which may not be removed.
We will
terminate the privileges of any user who uses this Site to unlawfully transmit
copyrighted material without license to do so. In particular, users who submit
content to this Site, whether articles, images, stories, music or other
copyrightable material must ensure that the content they upload does not
infringe the copyrights or other rights of third parties (such as privacy or
publicity rights). After proper notification by the copyright holder or it
agent to us, and confirmation through court order or admission by the user that
they have used this Site as an instrument of unlawful infringement, we will
terminate the infringing users' rights to use and/or access to this Site.
Disclaimers
What's on Downunder is committed
to maintaining the site in full working order at all times, and providing the
best service possible to its clients and customers. However due to unforeseen
circumstances the site may occasionally contain errors and may become
inaccessible on the World Wide Web. The Site and its content are delivered on
an "as-is" and "as-available" basis, it is the event
organizers responsibility to notify any event changes and cancellations. What's on Downunder is not responsible
for any errors made by event publishers.
What's on Downunder can
not ensure that files you download from the Site will be free of viruses or
contamination or destructive features. What's
on Downunder will not be liable for any damages of any kind arising from
the use of this Site.

disclaims any and all liability for the acts, omissions and conduct of any
third party users, What's on Sydney
users, advertisers and/or sponsors on the Site, in connection with the What's on Downunder service or
otherwise related to your use of the Site. What's
on Downunder is not responsible for the products, services, actions or
failure to act of any venue, performer, promoter or other third party in
connection with or referenced on the Site. Without limiting the foregoing, you
may report the misconduct of users and/or third party advertisers, service
and/or product providers referenced on or included in the Site to What's on Downunder at info@whatsonsydney.com. What's on Downunder may investigate the
claim and take appropriate action, in its sole discretion.
Limitation
on Liability
Except in jurisdictions where such provisions are restricted, in no event will What's on Downunder be liable to you
for any indirect, consequential, exemplary, incidental, special or punitive
damages, including also lost profits, even if What's
on Downunder has been advised of the possibility of such damages.

on Downunder and employees, harmless from any loss, liability, claim or
demand, including reasonable attorneys' fees, made by any third party due to or
